What is Form 1040-X?
Form 1040-X replaces figures on a return that has already been filed. For Americans in the UK it is most often used to add foreign income that was left off, to claim foreign tax credits that were missed, or to attach international forms that should have been there. It is also the vehicle for the amended returns that the Streamlined procedures require from people who filed but got it wrong.
Correcting a US return after it has gone
The form shows three columns for each line: the figure originally reported, the net change, and the corrected figure.
A written explanation of each change is required, and every schedule or form affected by the change goes in with it. For a UK resident, an amendment rarely touches one line. Adding UK interest can change the foreign tax credit limit, which changes Form 1116, which may change the carryover into the following year.
A refund claim is generally allowed within three years from filing or two years from payment, whichever is later. Claims arising from foreign tax credits follow a separate and longer period, which matters when UK tax for a year is settled late or HMRC later raises an assessment. Moving from the foreign earned income exclusion to the credit is also possible by amendment, but revoking the exclusion prevents a fresh election for five years without IRS consent, so later years need to be modelled before the change.
Amended returns also sit inside the Streamlined procedures. Someone who filed returns but omitted UK accounts or income files amended returns for the last three years with a signed certification of non-wilful conduct, plus delinquent FBARs for six years. On the Foreign route no miscellaneous offshore penalty applies. On the Domestic route a penalty of 5% is charged on the relevant foreign assets. Neither route is open once the IRS has started an examination.

I forgot to report my UK savings interest last year. Should I just amend?
Often an amendment is the right tool, especially where UK tax on the interest produces a credit that leaves little or no US tax. Where the omission is part of a wider pattern, such as unreported accounts or missing FBARs over several years, a formal route like the Streamlined procedures may give a better defined outcome. Which approach fits depends on the amounts, the years involved and the reasons for the omission.
Can I amend to claim a refund of tax I paid years ago?
The general window for a refund claim runs three years from filing or two years from payment, whichever is later. Claims that come from foreign tax credits have their own longer period, measured from the due date of the return for the year the foreign tax was paid or accrued. Outside those windows the IRS will usually refuse the refund even if the tax was overpaid. Dates should be checked year by year.
Will filing a 1040-X trigger an audit?
An amended return is reviewed by the IRS, as any return is, and a large refund claim naturally gets closer attention. There is no rule that amendment leads to examination. What matters more is that the explanation is clear, the supporting forms are complete and the figures reconcile with the UK records. A well-documented amendment is usually processed without contact, though processing times can be long.
